Terms & Conditions

The agreement that covers ordering, payment, delivery, warranties and your Australian Consumer Law rights when you shop with ZUA Health.

1. About these terms

These terms and conditions apply to your use of the ZUA Health website (zuahealth.com.au) and to purchases you make from ZUA Health, whether you order online or buy from our showroom at Unit 1, 2 Darnick Street, Underwood QLD 4119. By using the website or placing an order you agree to these terms. If you do not agree with them, please do not use the website.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

2. Ordering and acceptance

When you place an order you are making an offer to purchase. We accept your order when we send you an order confirmation email after your payment is processed. You will receive a further email with shipping details when your order is dispatched. Dispatch times are confirmed when you order, and freight for large items travels by consignment.

  • If an item you have ordered turns out to be out of stock, we will contact you to discuss other arrangements.
  • If we cannot accept or fulfil an order, for example because of an obvious pricing error or a stock issue, we will let you know and refund any amount you have paid in full.

3. Pricing

All prices on the ZUA Health website are in Australian dollars and include GST. We may change our pricing at any time without notice; the price that applies to your order is the price confirmed at checkout.

  • Crossed-out prices indicate the industry RRP, and not necessarily the price before a special or sale.
  • Our product pages include a "Found it cheaper?" price-match request. Price matching is at ZUA Health's discretion.

4. Payment

We accept card payments processed by Stripe, payments through PayPal, and Zip (buy now, pay later) where it is offered. Zip purchases are subject to Zip's own terms and approval. Your payment details go directly to the payment processor: ZUA Health never sees or stores your full card number. Your order is not confirmed until payment has been received.

5. Title and risk

Ownership of the goods passes to you once your order has been paid in full. Risk in the goods passes to you when the goods are delivered to your delivery address or when you collect them from our Underwood showroom.

6. Delivery

Delivery is covered in detail in our Shipping Policy, which forms part of these terms. In summary:

  • Freight is priced by your delivery postcode and the product's freight class. You can estimate it on the product page and in the cart, and the final amount is calculated at checkout from your delivery address and included in your order total.
  • Freight on some oversized items is quoted separately: we will contact you to arrange delivery. If we do not have a set freight rate for your postcode, we will confirm it with you before proceeding.
  • We make every attempt to charge freight correctly. If freight has been under-charged or over-charged, we will contact you with the correct pricing.
  • Deliveries are door to door only. "Door to door" means the ground-floor entrance and does not include stairs, lifts or difficult access. This is at the discretion of the delivery driver and in accordance with the carrier's handling policy. Any other delivery requirements must be pre-arranged with ZUA Health and will incur additional charges.
  • A re-delivery fee will be charged if you are not home to receive your delivery.
  • Pickup from our Underwood showroom can be arranged instead of delivery.

7. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

In practice this means that if a product has a major failure, you may choose a refund or a replacement. If the failure is minor, we may choose to repair, replace or refund. These rights apply automatically and are not affected by anything else in these terms.

8. Product warranties

The warranty period for each product is stated on its product page. If you order through an account, or one is created from your checkout details, you can view your equipment, warranty dates and warranty documents at any time in your account.

Warranty repairs and replacements may be carried out through the manufacturer's or distributor's warranty process, and ZUA Health will assist you with any claim. Our product warranties are provided in addition to your rights under the Australian Consumer Law, and nothing in a warranty limits those rights.

9. Returns and change of mind

If a product is faulty, your Australian Consumer Law remedies in section 7 always apply. Change of mind is different: it is not a right under the Australian Consumer Law, and returns for incorrect purchase or change of mind are accepted at ZUA Health's discretion only. Where we agree to a change-of-mind return:

  • the item must be unused, in new condition and in its original packaging, and accompanied by proof of purchase;
  • you must obtain our approval before sending anything back, so we can identify it when it arrives; and
  • return freight is at your expense.

For health and safety reasons, supplements can only be considered for a change-of-mind return if they are unopened.

10. Liability

To the extent permitted by law, and only in respect of goods or services not of a kind ordinarily acquired for personal, domestic or household use, the liability of ZUA Health for a failure to comply with a consumer guarantee is limited, at ZUA Health's election and as permitted by section 64A of the Competition and Consumer Act 2010 (Cth), to:

  • in the case of goods: the replacement or repair of the goods, the supply of equivalent goods, or the payment of the cost of replacing or repairing the goods or of obtaining equivalent goods; and
  • in the case of services: the supply of the services again, or the payment of the cost of having the services supplied again.

You agree to indemnify ZUA Health against losses, damages, costs and expenses (including reasonable legal costs) that ZUA Health incurs as a result of your breach of these terms or your unlawful use of the website. This indemnity does not apply to the extent that a loss is caused by ZUA Health.

11. General wellness products, not medical advice

ZUA Health products, including red light therapy equipment, infrared saunas, ice baths, compression recovery boots and supplements, are general wellness and recovery products. They are not medical devices and are not intended to diagnose, treat, cure or prevent any medical condition.

Content on this website, including product descriptions, articles and chat responses, is general information only and is not medical advice. Always consult a qualified health professional about your own circumstances, particularly if you are pregnant, have a medical condition or take medication.

12. Intellectual property

ZUA Health owns or licenses the intellectual property rights in this website and its content. You may view the website, and download or print pages for your own personal use. You must not, without our express written consent:

  • republish material from this website, including on another website;
  • sell, rent or sub-license material from the website;
  • reproduce, duplicate, copy or otherwise exploit material on the website for a commercial purpose; or
  • redistribute material from this website.

Other registered and unregistered trade marks appearing on the website are the property of their respective owners. Unless stated otherwise, we are not affiliated with, and do not endorse, the holders of those marks, and we cannot grant any licence to use them.

13. Website use and content

Acceptable use

You must not use the ZUA Health website:

  • in any way that causes, or may cause, damage to the website or impairment of its availability or accessibility;
  • in any way that is unlawful, fraudulent or harmful, or in connection with any unlawful, fraudulent or harmful purpose or activity;
  • to copy, store, host, transmit, publish or distribute any malicious software, including viruses, spyware, trojans, worms, keystroke loggers or rootkits;
  • for systematic or automated data collection, including scraping, data mining, data extraction or data harvesting, without our express written consent; or
  • to transmit or send unsolicited commercial communications, or for any marketing purpose without our express written consent.

We may restrict access to areas of the website, or to the whole website, at our discretion.

Website content and availability

Some information published on this website is supplied by manufacturers, wholesalers and distributors, and we do not always review or edit it. To the extent permitted by law, we do not warrant that the information on the website is complete or accurate, or that the website will remain available or up to date at all times. This does not affect your Australian Consumer Law rights in relation to anything you purchase.

14. Accounts and passwords

When you order, an account is created from your checkout details (or linked to your existing account) and you are sent a link to set a password. You can also order as a guest and view a guest order using its order number. Signed-in customers can see their orders, saved addresses, equipment and warranty documents in their account.

You must keep your password confidential and must not use another person's account. Please notify us in writing immediately if you become aware of any unauthorised use of your account. You are responsible for activity on your account that results from a failure to keep your password confidential. We may suspend or disable an account that we reasonably believe has been used in breach of these terms.

15. General

Changes to these terms

We may revise these terms from time to time. Revised terms apply to the use of the website and to orders placed from the date they are published on this page. Please check this page from time to time so you are familiar with the current version.

Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in full force.

Governing law

These terms are governed by the laws of Queensland, Australia, and you and ZUA Health submit to the jurisdiction of the courts of Queensland.
